In this Thematic Unit, students will explore some of the most important aspects of the two-way relationship between criminal justice and human rights: human rights on the one hand constitute a restriction on the repressive function of criminal law, while on the other hand criminal law is one of the most effective means of realizing the state's obligation to protect human rights through the criminalization of their violation. In this context, the thematic unit will address a number of crimes directly related to human rights, such as hate crimes, as well as the human rights implications of anti-crime policy. The rights of suspects during arrest and interrogation, the rights of inmates in pre-trial detention, the right of defendants to a fair trial, the rights of prisoners, as well as the rights of victims and their relatives will also be examined.
